The Town of Middlebury Public Safety & Health Committee will discuss the town's ordinance for the regulation of noise at its meeting on Monday August 8, beginning at 4 pm in Middlebury Police Department Conference Room. The meeting is open to the public for their input.
The purpose of the noise ordinance is to “protect the comfort, quiet, repose, health, peace or safety of others in the immediate area of a noise disturbance”. The ordinance defines certain specific activities which constitute unreasonable, unnecessary, or excessive noise – electronic noise, construction noise, trash collection, and sets about time parameters where this noise is prohibited.
A couple of the residents that live near the airport have contacted the Middlebury Police Department about the town's noise ordinance and its relevance to airport operations. They've asked that the provisions of the ordinance be used as a precedent to controlling airport noise. They understand the need for commercial and general aviation use of the airport. Their concern is expansion of airport activities into night time operation and unlimited weekend use. While the ordinance already does restrict certain commercial activities (start and stop times of construction activities and trash collection), it does not address others, leaving airport activities outside the definition of “unreasonable or unnecessary noise”. If aviation related noise is exempted by state or federal law, then the town needs to amend the ordinance to include that.
