NOTICE OF EXAMINATION OF PREMISES AND PUBLIC HEARING FOR PROPOSED LAY OUT OF NEW CLASS 3 TOWN HIGHWAY RIGHT-OF-WAY – MILTON "HOURGLASS PROJECT" SOUTHERLY LEG

Pursuant to its petition and motion approved on January 2, 2024, and the requirements of Title 19, Chapter 7 of the Vermont Statutes Annotated, the Town of Milton Selectboard will open an examination of the premises and public hearing on Monday, February 12, 2024, at 6:00 p.m. at the Milton Town Office, 43 Bombardier Road, Milton, VT 05468, which is expected to be promptly adjourned that evening and reconvened on Monday, February 26, 2024, with an inspection of the premises to be held at 4:00 p.m. and the continued public hearing at 6:00 p.m. to consider whether the public good, necessity and convenience of the inhabitants of the Town warrant laying out a new Class 3 town highway known as the southerly leg of the so-called "Hourglass Project" and the amount of any damages due to affected landowners. All interested parties shall meet for the following:

1. An inspection of the premises at 4:00 PM on Monday, February 26, 2024, to be commenced at the Milton Town Office, 43 Bombardier Road, Milton, VT 05468 and then reconvening at or near the intersection of Railroad Street, Middle Road and U.S. Route 7 (near the structure identified as 214 U.S. Route 7 South, Milton, Vermont):

The new town highway right-of-way is proposed to run in an generally northwesterly-southeasterly direction across the property now owned by the Papaseraphim Family Revocable Living Trust, and is proposed to require the taking of +/-0.94 acres of land in fee simple from the Papaseraphim Family Revocable Living Trust, rights for a new driveway to the remaining lands of the Papaseraphim Family Revocable Living Trust extending southerly and southeasterly from U.S. Route 7, and related utility, temporary slope and construction easement rights.

2. A public hearing following the inspection of the premises at 6:00 PM at the Milton Town Office, 43 Bombardier Road, Milton, VT 05468, to receive testimony from all persons abutting, owning or interested in the matter of laying out the town highway right-of-way known as the southerly leg of the so-called "Hourglass Project," which may be adjoured to a date certain thereafter.

Persons wishing to comment, provide testimony or give evidence regarding the proposal may do so in person during the hearing, or by filing their comments, in writing, prior to the hearing.

After examining the premises and hearing from any and all interested persons, if the Selectboard judges that the public good, necessity and convenience of the inhabitants of the Town of Milton warrants laying out a new Class 3 town highway known as the southerly leg of the so-called "Hourglass Project," it will be so ordered.
